Age Discrimination Claim

As is true with any employment discrimination or sexual harassment claim, an age discrimination claim must be filed in a timely manner to be heard by the courts. There are short statutes of limitation that make it wise for you to consult with legal counsel right away if you suspect that you might have an age discrimination lawsuit. Before you file an age discrimination lawsuit, it is generally advisable to file a charge of unlawful discrimination with the United States Equal Employment Opportunity Commission (EEOC) or the Minnesota Human Rights Department (MHRD). These agencies can investigate your charge and if your charge has merit, they can make a finding of probable or reasonable cause and issue notice of right-to-sue letter. Upon receipt of the letter, the law gives you again a short time period in which to file a lawsuit. You must actually file the lawsuit in court within this short window of time or your claim could be forever barred.

To prove that your employer discriminated against you because of age, you must usually demonstrate that the following have occurred:

  • You are a member of a protected class (generally considered to be 40 or above);
  • You were qualified for the job;
  • You suffered an adverse employment action; and
  • The employer's explanation of why it took the action is unworthy of belief and the employer was more likely than not motivated by your age
